Spain's Congress Repealed Housing Decree-Laws 26/2026 and 27/2026 on 2 October

Spain's Congress voted on 2 October 2026 to repeal both housing decree-laws, and the state gazette published the agreements the same day, so the new rent rules lapse. deputies voted against decree-law 26/2026, by press count.

The facts

  • Congress held an extraordinary plenary session on 2 October 2026 whose single item was the validation or repeal of decree-laws, covering files 130/000055 and 130/000056.
  • Decree-law 26/2026, on the social function of housing and the expansion of affordable supply, was not validated. Press accounts of the session report 172 votes in favour and 178 against.
  • Decree-law 27/2026, on the stability of contracts for renting a habitual residence, was repealed in the same session.
  • The Boletin Oficial del Estado published both repeal agreements in issue 245 of 2 October 2026, signed by the President of Congress.
  • Both decree-laws carried the date 29 September 2026.

What it means for your money

  • The rent rules introduced days earlier no longer apply. Landlords and tenants fall back on the terms that were in force before.
  • For tenants the contract-stability protections are gone; for landlords the affordable-supply obligations go with them. The repeal removed both sides of the package at once.
  • Glopra's Spain entry shows a national asking rent of 17.5 US dollars per square metre a month, a portal figure for August 2026, which is to say from before the decrees existed and under the rule set that applies again now.
  • The repeal agreements published in the gazette set out the repeal itself. They say nothing about leases signed during the four days the decrees were in force.
