Indonesia: Foreign Property Ownership and the Buying Process, Title by Title
Freehold is closed to foreigners in Indonesia, but Hak Pakai, strata title and a Bali lease are not. What each one gives you, and what the purchase costs.
Indonesia occupies an odd position in our data. The gross rental yield of 8.30% is one of the highest we measure anywhere, yet the average price of 2,144 USD/m² sits 9.6% below where it stood ten years ago in dollar terms (Glopra snapshot, 2026-07-23, v3 methodology). The return has come out of rent, not out of the price, which puts unusual weight on the legal wrapper: a right with an expiry date is a rent stream with an expiry date.
Which titles is a foreigner allowed to hold?
Hak Milik, full ownership, is reserved for Indonesian citizens by Article 21(1) of the Basic Agrarian Law, UUPA 5/1960. Article 26(2) goes further: a sale meant to pass Hak Milik to a foreigner is void by operation of law, and the land falls to the state.
What is open is set out in Government Regulation PP 18/2021, which replaced PP 103/2015 and PP 40/1996, and in the implementing Permen ATR/BPN 18/2021. For a landed house the instrument is Hak Pakai, the right of use, over state land or over land already held under Hak Milik or Hak Pengelolaan. For an apartment a foreigner may hold strata title to the unit where the plot beneath carries Hak Pakai or Hak Guna Bangunan. HGB itself belongs to Indonesian citizens and to companies incorporated in Indonesia, hence the PT PMA under so many villa structures.
Does a foreigner still need a KITAS?
Article 69(1) of PP 18/2021 requires immigration documents as prescribed by law, and the official elucidation names a visa, a passport or a residence permit issued by the competent authority. That is wider than the pre-2021 reading. Land offices do not all move at the same speed, so ask the district BPN office to confirm in writing what it accepts.
Price is a separate gate. A minimum acquisition value applies below which a foreigner may not buy, and it lives in a ministerial decision, Kepmen ATR/BPN 1241/SK-HK.02/IX/2022, rather than in a statute. The floor differs by province and again between a house and an apartment, with Jakarta and Bali at the top, and it is revised without parliament. Check the figure in force on the day you sign.
How long does the right actually run?
PP 18/2021 gives Hak Pakai and HGB the same shape: up to 30 years on grant, up to 20 more on extension, up to 30 again on renewal. Eighty years is a ceiling, not a default, and each step depends on the land still serving its stated purpose and the holder still qualifying.
Set that against the money. Completing a purchase costs 11.8% of the price, and a non-resident landlord carries a 20% effective tax on rent, since PPh Pasal 26 withholds 20% of the gross unless a treaty rate is evidenced (Glopra snapshot, 2026-07-23, v3 methodology). At 8.30% gross the entry cost is earned back within a few years. A yield is only perpetual if the title is.
Why does the nominee route keep failing?
Buying in an Indonesian friend's name and papering it over with a loan, a mortgage and a repurchase option is the arrangement Article 26(2) voids. Those side documents may bind the people who signed them; none creates a right over land. A court reads the name on the sertifikat, and death, divorce and the claims of heirs attach to that name, not to yours.
Is a Bali lease a title at all?
Hak Sewa, the lease behind most Bali villas, comes from Articles 44 and 45 of the UUPA and is a contract, not a registered land right. Nothing about it reaches the BPN certificate, so the notarised agreement is the whole of your protection, and extension is negotiated rather than owed.
What does the transaction look like from the inside?
It begins with a certificate check at the district land office, confirming the seller's title and revealing any mortgage or dispute. Only a PPAT, the land deed official, may draw the AJB, the deed of sale, once tax is settled; a PPJB buys time first. Nothing is finished until the new name is registered at BPN. The buyer's duty is BPHTB, capped at 5% by UU 1/2022. If a building is involved, ask for its PBG, the approval that replaced the old IMB under PP 16/2021. Against a price-to-income ratio of 25.5 and a bubble-risk score of 73, which we read as elevated, none of this is paperwork to delegate.
