Portugal 2026: foreign property ownership and the buying process
Portugal puts no nationality bar on owning property, yet a rule that took effect in May 2026 made the entry ticket noticeably dearer for non-residents.
Two buyers sit down at the same Portuguese notary's table, one holding an EU passport and one holding a Brazilian one. Nothing in the deed will separate them. What changed recently is not who may buy, but what the purchase costs.
Is there a nationality bar on owning Portuguese property?
There is none. Acquisition is a matter of contract and registration, not of citizenship or residence status. The official gov.pt guidance on compra e venda de imóveis lists what any purchaser has to verify and attaches no condition about where the buyer lives. Ownership is full ownership: it can be sold, let, mortgaged or inherited on the same terms available to a Portuguese national.
What must a non-resident sort out before signing anything?
A número de identificação fiscal comes first. The Autoridade Tributária issues it at any serviço de finanças or Loja do Cidadão, and foreign nationals may also apply through the e-balcão on the Portal das Finanças. A passport plus proof of an address abroad are the core documents, and anyone applying on a buyer's behalf needs a notarised power of attorney.
Buyers resident outside the EU and the EEA then meet a second duty. The Portal das Finanças states that they must either appoint a fiscal representative in Portugal or enrol in electronic notifications, within fifteen days, under penalty of a fine of 75 to 7,500 euros and the loss of standing in complaints and appeals. For EU and EEA residents, both options remain voluntary.
Which certificates show whether the property is clean?
Four documents carry most of the weight. The caderneta predial from the tax authority describes the property as the state has it recorded. The certificate from the conservatória do registo predial shows the ownership chain, mortgages and charges, and since 21 May 2026 the Ministry of Justice issues its access code immediately through the new conservatoria.justica.gov.pt portal, valid for six months. The licença de utilização is required for anything built after August 1951. The ficha técnica de habitação, created by Decreto-Lei 68/2004 and supervised by IMPIC, must be handed over by the developer at the deed whenever the use licence dates from after 30 March 2004. An energy certificate completes the file.
How binding is the contrato-promessa, and what happens at completion?
More binding than most first-time foreign buyers expect. The sinal paid on signature is not a soft reservation fee. Article 442 of the Código Civil is blunt: if the party who paid it defaults, the other side keeps it; if the other side defaults, the payer may demand double what was handed over.
Completion runs as an escritura pública before a notary or as an authenticated private document, and gov.pt confirms it can equally be done at Casa Pronta, the justice ministry's single counter, where sale, mortgage, taxes and registration are settled together for 375 euros for one registration act and 700 euros where several acts are involved. Legal pre-emption has to be cleared first: inside an urban rehabilitation area the municipality is notified through the Casa Pronta portal and has eight working days to step in. Registration must then be requested within two months under article 8-C of the Código do Registo Predial.
What does entry cost, and what does the market give back?
This is where the picture turns. Decreto-Lei 97/2026, published on 20 May and applying from 25 May 2026, subjects non-resident buyers of residential property to a flat IMT rate of 7.5 per cent with exemptions and reductions switched off. It falls away where the buyer is a Portuguese tax resident, becomes one within two years, or lets the home at moderate rents within six months and keeps it let for at least thirty-six months during the first five years; in the latter two cases the difference is reclaimable. Stamp duty adds 0.8 per cent under heading 1.1 of the general table.
Our own measurement of the full round trip, 11.2 per cent of price (Glopra snapshot, 2026-07-23, v3 methodology), sits against an average of 2,659 USD per square metre and a gross rental yield of 4.29 per cent. Prices are 14.5 per cent higher over twelve months and 69.5 per cent higher over five years in dollar terms, which is also why our bubble risk score for Portugal reads 84 points, the highest reading in our sample. Legal access is cheap here. Financial access is not.
Does buying a home still open a residency route?
No. The investment categories under article 3 of Lei 23/2007 that rested on acquiring property were repealed by the Mais Habitação reform, and the surviving categories may not be directed at real estate, whether directly or indirectly.
